Central Ac Unit That Was Installed And Not Needed

I had a central air conditioner unit installed I was told I needed a new one. After the installation the new unit was doing the same thing that the old unit did.

I now found out that it wasn't the unit but I have leaking ducts. Can I hold the company responsible even though the contract says they are not responsible for duct work. This should have been checked before the unit was installed.
